Agreement to Terms

By accessing or using ClockThatTea, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this application.

Age Requirements

You must be at least 18 years of age to use ClockThatTea. By using this service, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from users under 18 years of age.

User-Generated Content and Platform Status

ClockThatTea is a social media platform that allows users to post content. Users are solely responsible for all content they post, upload, share, or otherwise make available through the service. ClockThatTea acts as a neutral platform and does not create, endorse, or control user-generated content.

By posting content, you represent and warrant that: (1) you own all rights to the content or have obtained all necessary permissions, (2) the content does not violate any third-party rights, including intellectual property, privacy, or publicity rights, and (3) you have the legal right to post such content.

Content License and Rights

By posting content on ClockThatTea, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute your content in connection with operating and providing the service. You retain all ownership rights to your content.

User Indemnification

You agree to indemnify, defend, and hold harmless ClockThatTea, its officers, directors, employees, agents, and third parties, from and against any losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to your use of the service, your content, or your violation of these Terms.

Prohibited Content and Conduct

Users may not post content or engage in conduct that:

• • Contains images, videos, or information about other individuals without their explicit consent
• • Violates any person's right of privacy or publicity
• • Is defamatory, libelous, or contains false statements about others
• • Constitutes harassment, bullying, or intimidation
• • Infringes on intellectual property rights of others
• • Contains hate speech, threats, or incites violence
• • Is sexually explicit or contains nudity
• • Violates any applicable laws or regulations

Content Moderation and Removal

ClockThatTea operates on a notice-and-takedown model. We do not pre-screen content but will investigate reports of policy violations and remove content that violates these Terms. We reserve the right to remove any content and terminate user accounts at our sole discretion. Content removal requests must include specific identification of the violating material.

DMCA Copyright Policy

ClockThatTea respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please provide our designated DMCA agent with:

• • Identification of the copyrighted work claimed to be infringed
• • Identification of the infringing material and its location
• • Your contact information
• • A statement of good faith belief that use is not authorized
• • A statement of accuracy and authority to act on behalf of the copyright owner

Limitation of Liability

Platform Immunity

ClockThatTea is protected under Section 230 of the Communications Decency Act as an interactive computer service provider. We are not liable for content created by users and do not exercise editorial control over user-generated content. Any disputes regarding user content should be directed to the individual users who created such content.

Dispute Resolution

Any disputes arising from these Terms or your use of ClockThatTea shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class-action lawsuits or class-wide arbitration.

Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms of Service. Users who repeatedly violate our content policies or terms will be permanently banned.

Third-Party Claims

If you receive a complaint from a third party regarding content you posted, you are solely responsible for addressing such complaints. ClockThatTea is not obligated to mediate disputes between users or between users and third parties.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any legal actions must be brought in the state or federal courts located in Delaware.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

Changes to Terms

ClockThatTea reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the service after changes constitutes acceptance of the new Terms.
